Tesla’s Texas Megapack Plant Gets Foreign-Trade Zone Status, But China Tariffs Still Apply

Tesla’s Megapack factory in Brookshire, Texas, has been approved as a foreign-trade zone by the US Foreign-Trade Zones Board, according to a notice in the Federal Register published Monday. The designation, effective for 14 months, allows Tesla to defer, reduce, or eliminate customs duties on imported components used in manufacturing—provided the finished products are exported. However, Tesla’s application explicitly states that parts subject to Section 301, Section 232, or Section 122 tariffs will still incur those duties, meaning Chinese lithium iron phosphate battery cells used in Megapacks will not escape existing trade penalties. The move highlights how companies navigate complex trade rules to manage costs while complying with tariff policies. For Tesla, the FTZ status could improve cash flow and competitiveness in global energy storage markets, especially as demand for grid-scale batteries grows. But the continued application of China-specific tariffs underscores the Biden administration’s firm stance on strategic supply chains. Industry watchers will monitor whether other battery manufacturers seek similar designations as US energy storage production expands.
